Military duty (mobilization)

Protection of the Motherland, independence and territorial integrity of Ukraine is a constitutional duty of the citizens of Ukraine.
Conscription includes not only the performance of military service, but also training for military service, compliance with military registration rules, conscription or acceptance under contract, and fulfilment of military duty in the reserves and reservists.
Both women and men have the military duty. In particular, women who have the specialty and / or profession related to the relevant military accounting specialty and are eligible for military service due to age and health are registered as conscripts. Please note that these women become obliged to register themselves as conscripts from 01 October 2022. Such women may be called up for military service or recruited to carry out national defense work during wartime and mobilization.
The Law of Ukraine “On Military Duty and Military Service” distinguishes the following types of military service:

military service;
-
military service on call during mobilization, for a special period;
-
military service under the contract of privates;
-
military service under the contract of sergeants and non-commissioned officers;
-
military service (training) of cadets of higher military educational institutions, as well as higher educational institutions consisting of military institutes, faculties of military training, departments of military training, departments of military training (hereinafter – higher military educational institutions and military educational units of higher educational institutions );
-
military service under the contract of officers;
-
military service on the conscription of officers;
-
military service on the call of reservists in a special period.
Male citizens of Ukraine who are fit for this purpose due to their state of health, who have reached the age of 18 by the date of conscription, and senior persons who have not reached the age of 27 and are not entitled to exemption or deferment of conscription are called up for military service. Postponement of military service is granted due to family circumstances, state of health, education and continuation of professional activity.
In connection with the threat of armed aggression, on February 22, 2022, the President, as Supreme Commander-in-Chief of Ukraine, issued an Order “On conscription of reservists for military service at the conscription of reservists in a special period” No. 2, and on February 24, 2022, by the Decree of the President of Ukraine No. 69/2022, a general mobilization was announced, that is, one that is carried out throughout Ukraine.
The Decree “On general mobilization” provides for mobilization for 90 days. Reservists and conscripts who are in reserve for the replenishment of military positions provided by wartime states are called up for military service during mobilization. The maximum age for military service during a special period is 60 years, and for senior officers – 65 years.
The following people have the right to military service deferment during mobilization:

people reserved for the mobilization and wartime period;

people recognized in the prescribed manner as persons with disabilities or, in accordance with the conclusion of the military medical commission, temporarily unfit for military service for health reasons for up to six months (furthermore, they must see a medical board);

women and men who have three or more dependent children under the age of 18;
-
women and men who raise a child (children) under 18 as single parents;
-
women and men, guardians, caregivers, adopting parents, foster parents who raise a disabled child under the age of 18;
-
women and men, guardians, caregivers, adopting parents, foster parents who raise the child with severe perinatal nervous diseases, severe birth defects, rare orphan diseases, oncological, oncohematological diseases, cerebral palsy, severe mental problems, diabetes mellitus type I (insulin-dependent), acute or chronic kidney diseases degree IV, the child who got injured severely, needs the organ transplant, needs palliative care, which is proved by the document issued by the Physician Advisory Committee of the healthcare center according to the procedure and in form established by the central executive body in charge of elaborating and implementing the state healthcare policy, but which does not establish the disability;
-
women and men who have the dependent child of age who is the disabled person, group I or II;
-
adopters, guardians, caregivers, foster parents who support orphans or children under the age of 18 deprived of parental care;
-
persons who take permanent care of their sick wife (husband), child, as well as their parents or wife (husband) who, according to the opinion of the medical and social expert commission or the medical advisory commission of the healthcare institution, is in need of permanent care;
-
persons who have a disabled wife (husband) and / or one of their parents or parents of their wife (husband) with disabilities, group I or II;
-
guardians of the disabled person recognized by court as incapable; persons who take permanent care of the disabled person, group I; persons who take permanent care of the disabled person, group II, or the person who, according to the opinion of the medical and social expert commission or the medical advisory commission of the healthcare institution, is in need of permanent care, unless there are other persons who can provide such care;

women and men who have an underage child (children) and a husband (wife) who are doing military service as one of types of military serviceperson;
-
people's deputies of Ukraine, deputies of the Verkhovna Rada of the Autonomous Republic of Crimea;
-
employees of military administration bodies (governing bodies), military units (divisions), enterprises, institutions and organizations of the Ministry of Defense of Ukraine, Armed Forces of Ukraine, State Service for Special Communications and Information Protection of Ukraine, Security Service of Ukraine, Foreign Intelligence Service of Ukraine, National Guard Ukraine, State Border Guard Service of Ukraine, National Police of Ukraine, tax police, National Anti-Corruption Bureau of Ukraine, State Bureau of Investigation, State Executive Service of Ukraine, State Security Department of Ukraine.

other persons subject to conscription, or certain categories of citizens in cases prescribed by law.
The following people are also not subject to conscription during the mobilization and for a special period:
- students of professional and higher educational institutions, trainee assistants, post-graduate students, and doctoral students studying on a full-time or part-time basis;
- scientific and scientific-pedagogical employees of higher educational and professional institutions, scientific institutions and organizations with academic degree and / or scientific degree, and pedagogical employees of general secondary educational institutions, provided that they work for the higher educational and professional institutions, scientific institutions and organizations, general secondary educational institutions respectively on the primary employment basis with the wage rate of at least 0.75%;
- women and men whose close relatives died or went missing during the anti-terrorist operation.
In addition to military service, citizens of Ukraine are involved in the Territorial Defense Forces of the Armed Forces of Ukraine. Citizens of Ukraine may, on a voluntary basis, join voluntary formations of territorial communities or be called up or recruited under contract for military service in the ranks of the Territorial Defense Forces.
A member of a volunteer formation may be a citizen of Ukraine over 18 years of age who lives in the community where the volunteer formation operates, has passed medical, professional and psychological selection (inspection) and entered into a contract of volunteer territorial defense. Membership in a voluntary formation does not release from the obligation to pass military service.
